Introduction:
By using the Phagenomics service ("Service") provided by PrecisionPhage Ltd ("we," "us," "our"), you ("you," "your," "user") agree to the following Terms and Conditions ("Terms"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
Subscription Model:
The Service is available on a two-tier subscription model: Free and Pro. The Free tier is available at no cost, while the Pro tier requires a monthly subscription fee, which is billed automatically. Users can access a 7-day trial for the Pro tier, which automatically continues as a Pro subscription if not cancelled within the trial period. The Pro subscription can be cancelled at any time during the subscription. You will retain access to Pro features until the end of the billing period if cancelled.
Usage Limits:
There is a maximum number of genomes that can be analysed per month, depending on the subscription tier. Free tier users can analyse up to 3 genomes per month, while Pro tier users can analyse up to 20 genomes per month. These limits are automatically enforced.
Student and Academic Discounts:
We offer student and academic discounts for the Pro tier. Our platform automatically recognises your affiliation based on your email domain – student and academic discounts thus require an email address from an academic institution. You may contact us if you believe we have mistakenly classified your email as non-academic. While an academic email grants the ability to sign up for both academic or student subscription, you are not permitted to sign up for a student discount without a valid student status. We periodically enforce users' student status through queries and reserve the right to cancel subscriptions in cases of intentional subscription to a student plan without a valid student status.
Refund Policy:
Our Service is billed on a subscription basis and is non-refundable. Exceptions to this policy will be considered on a case-by-case basis, at our sole discretion. Please note that canceling your subscription prevents future charges but does not result in a refund of past charges.
Data Submission and Ownership:
You retain the ownership of the raw sequencing reads submitted to the Service. However, by submitting your data, you grant us the rights to utilize the raw reads and the assembled genomic data to train artificial intelligence (AI) models and develop the Service.
Data Use and Privacy:
Your data will be stored on third-party servers provided by DigitalOcean S3 as well as in a database managed by DigitalOcean. These tools assist us in storing and managing your raw sequence reads, assembled genomes, analysed genomes and project data securely. We do not share your personally identifiable information with DigitalOcean or any other third parties for marketing purposes or any other purposes outside of providing and improving our Service, unless explicitly stated or in accordance with our Privacy Policy. Any data shared with third parties will be anonymized and aggregated whenever possible, and we take measures to ensure any third-party providers uphold strict data protection and privacy standards. The data submitted to the Service will be anonymized and aggregated before being utilized for AI training. You are not permitted to submit sensitive or otherwise protection-requiring data to the Service (for example, patient names or genomic data). We comply with GDPR by asking for consent on optional tracking cookies from Google Analytics.
Third-Party Login:
We offer the ability to log in to our Service using Google authentication. If you choose to use this feature, you will be sharing some personal data with Google as a third-party service provider. The data shared with Google is used only for authentication and to facilitate the login process. We do not receive or store your password. Direct Login System:
For users who sign up directly on our Service, we use Django-based authentication. The information you provide during the registration process such as username and password is stored on our secure servers and used solely for the purposes of authentication and providing service access. We take the security of your data seriously. Passwords are hashed and not viewable by anyone, including our team. It is important that you maintain the confidentiality of your login details and notify us immediately if you suspect any unauthorized use of your account.
Data Storage:
Raw sequence reads, assembled genomes, analysed genomes and project data will be stored on our server with no expiration date. Data storage is handled by secured data storage providers. Removing phages from the Service results in removal of associated data. Some data may be stored on our analysis server separate from the main data storage as a byproduct of running the bioinformatic pipelines. This data is not automatically deleted upon deleting a phage or project. You have the right to request complete deletion of your data.
Acceptable Data Types:
The raw data submitted is limited to Illumina sequence data. For preassembled genomes we only allow fasta files. Any other types of data are not acceptable and may result in an inability to utilize the Service properly. We monitor file format closely and an attempt to purposefully upload harmful files will result in termination of your account.
Therapeutic Analysis and Recommendations:
While our Service provides analysis on phage genomes and their potential applicability for phage therapy, this information is not intended to be and should not be interpreted as a recommendation or endorsement for any specific treatment or therapy. The decision to use a phage for therapeutic purposes should be made in consultation with a healthcare provider and based on a thorough evaluation of the phage's safety and efficacy also on a phenotypic level. PrecisionPhage Ltd does not assume responsibility for any decisions made or actions taken in reliance on our Service's analysis.
Security:
We take measures to ensure the security of your data. In the event of a security breach affecting your data, we will notify you as per applicable laws and regulations.
Use of Cookies and Google Analytics:
We use cookies to enhance user experience on our Service. Cookies are small data files stored on your device by the Service. We employ Google Analytics, a service which transmits website traffic data to Google servers. Google Analytics does not identify individual users and does not associate your IP address with any other data held by Google. We use reports provided by Google Analytics to help us understand website traffic and webpage usage. By using our Service, you consent to the processing of data about you by Google in the manner described in Google's Privacy Policy and for the purposes set out above. We use Sentry, a third-party service, to collect data and report on errors that occur within our application. This allows us to monitor application performance and address any issues promptly. Asynchronous Task Processing:
Our Service incorporates asynchronous task processing, which involves separate computation activities occurring independently of the main application workflow. These tasks are processed on a secure virtual machine managed by CSC – TIETEEN TIETOTEKNIIKAN KESKUS OY, Finland. This allows us to streamline our service, manage resources effectively, and provide a better user experience. During this processing, your genomic data may be temporarily stored or transferred within our systems; however, we ensure that the same robust standards of data protection and privacy apply.
Payment Processing:
We process payments through a third-party payment service provider, Stripe. By making use of our Service, you grant us and Stripe the necessary permissions to process your payments. We do not store your card details on our servers; instead these details are managed by Stripe, which has its own robust security and privacy safeguards. Termination:
Your access to the Service may be terminated if you are found to have breached these Terms and Conditions. Such breaches may include, but are not limited to, actions that deliberately aim to harm the Service, submission of illegal content, abusive behavior towards other users, and attempts to breach the service's security. If your account is terminated, we will notify you, providing the reason for the termination where possible. Warranty:

PrecisionPhage Ltd is not a healthcare or medical service provider. Our Service is intended to provide insights based on phage genome analysis only, and should not be used for making any direct medical decisions or treatments without professional medical advice. We suggest users to consult with healthcare professionals for health-related decisions. To the maximum extent permitted by the law of Finland, PrecisionPhage Ltd and its directors, employees, agents, partners, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if PrecisionPhage Ltd has been notified of the possibility of such damage.
Indemnity:
You agree to compensate PrecisionPhage Ltd, our partners, employees, and other associates, for any costs, losses or damages we might incur as a direct or indirect result of your use of our service, if you're not following these Terms, or any laws and regulations applicable to you. This includes legal fees, fines, and any other expenses.

The Service is provided "as is," without any warranties or liability. We do not make any guarantees regarding the accuracy or completeness of the analysis provided by the Service. Furthermore, we are not responsible for any actions taken by users based on the information or insights provided by our Service. Users are recommended to use their discretion and, where necessary, seek professional advice before acting on any information obtained from the service.
Amendment to Terms and Conditions:
We may amend these Terms from time to time. You are required to accept any changes to the Terms when logging onto the Service. If you do not agree to the new Terms, you must cease using the Service.
